NOTICE OF LAND USE PUBLIC HEARING JANUARY 17, 2023 at 7PM

  • HICKMAN MINOR PARTITION LU 447-2022 : The subject site is located at 895 Sommerville Loop. and is also known as tax lot 3000 of Linn County Assessors Map 15S04W15CA.  The applicant requests approval of a minor partition to divide a 40,639 Sq. Ft. lot into three parcels.  Proposed Parcel No. 1 will contain the existing single-family dwelling, and accessory structures while Parcels 2 and 3 are being designed for single family dwellings.

Citizens may provide testimony either in person or in writing.  Written comments may be submitted any time prior to the start of the meeting.  If a citizen wishes to have their written comments included as part of the agenda, then the City Recorder must receive them by January 6, 2023. (All digital and written comments are part of the public record.) The Chairperson will set a time limit of three minutes per person for oral testimony at the public hearing following the staff reports and applicants’ presentation.

Failure of an issue to be raised in a hearing, either in person or in writing, or failure to provide sufficient specificity to afford the decision-making body an opportunity to respond to the issue precludes an appeal to the State Land Use Board of Appeals (LUBA), the City Council, or Circuit Court, based on these issues. The failure of an applicant to raise constitutional or other issues relating to the proposed conditions of approval or specific criteria with sufficient specificity to allow the decision maker to respond to the issue precludes an action for damages in circuit court.

All applications, documents, and evidence are available for viewing at City Hall at no cost. Copies of the material will be provided at a reasonable cost. A copy of the staff report will be available for inspection at no cost seven days prior to the hearing.  The City will mail the notice of decision to citizens who submit written comments, or who are otherwise legally entitled to notice.

City Hall is handicapped accessible.  Persons with disabilities wishing accommodations, including assisted listening devices, sign language, or persons with special needs are requested to contact City Hall at (541) 995-6655, at least 48 hours prior to the meeting date.
